U.S. District Judge Carl Nichols broke with at least seven Washington judges who ruled that charging Capitol Hill rioters with obstruction is permissible.

On Thursday’s episode of “LevinTV,” Mark looked at Judge Nichols’ decision to dismiss trespassing charges against an individual arrested in connection to the Capitol riots. Recently released video footage from the “day democracy almost died” appeared to show Capitol Police calmly granting protesters access to the building through the West entrance.

The video, which shows protesters and police officers acting calm and orderly, is “too spicy” for social media platforms. However, you can watch it here.

Trespassing, by definition, is a legal term for entering onto the land of another with permission or the legal right to be there. Video, however, appears to have captured the protestors being waved through the doors.

In Mark’s opinion, Capitol Police appeared to be welcoming protesters through the terrace doors. It is essential to separate the unacceptable violent groups from the unfortunate protestors whose curiosity led them into something beyond their control.

You can watch the video here.
